Auto Accident Checklist

FLT Law

Traffic.  Traffic.  Traffic.

Back-to-school time always brings an increase in traffic on our roads.  Our expressways rank among the most congested in the country.  Plus, we navigate red-light cameras, runners, bikes, trucks, and, the ever-present ‘construction’.

It’s no surprise that along with the increased congestion, there is an increase in crashes, collisions, and auto accidents.  As an Chicago auto accident attorney, every day I am personally involved in fighting for those who are injured as a result of the negligence of others.    Injuries from car accidents can be severe and life-changing.

Chicagoland Car Accident Liability.

Usually liability for an auto accident is fairly clear and one-sided.  Anyone injured has the right to receive compensation from the at-fault driver.

If you’re injured in an auto accident, here’s an auto accident checklist that will assist you.

What To Do Checklist.

√   Police.  When an accident occurs, always call the police – even if the accident appears minor.  After their investigation, the officer will issue a police report.  A police report is very important to your case.

√   Get Information & Photos.   Never leave the scene of an accident without photographs and the names and contact information of witnesses and the other drivers.  Most cell phones today have cameras that you can use to photograph vehicle positions, body damage, skid marks, and road conditions.

√   Medical Treatment.   If you are feeling ill, seek immediate medical attention.  Car accidents often result in whiplash, concussions, soft tissue injuries, and muscle and bone damage.    You and your passengers may be in shock, confused, or scared.  When you call the police, their dispatcher can also send an ambulance for emergency treatment.  Take photos of any cuts, bruises, or physical injuries that may not be part of the medical report and X-rays.

√   Document.   Create a folder for all details of the accident.  Photos, diagrams, witnesses, medical records, treatments, prescriptions, travel expenses, lost wages, car rental, and other expenses.  Also record how you are feeling during your recovery.   Your attorney will find this information enormously helpful in investigating and holding the responsible party accountable.

√   Hire an Attorney.   You need an attorney experienced in Personal Injury cases.  Do not wait.  We can help you avoid mistakes that may weaken your case.    We also can help you keep track your medial treatment, ensure that no legal deadlines are missed, advise you on realistic compensation, and keep the case moving forward.

√   Report.   Notify your insurance company and provide the police report number.  In Illinois, you must complete and mail a report to the Secretary of State.  We can assist you with these details.  There is a deadline for filing your case.  Do not wait.

What NOT To Do.

Statements.  Never give a written or recorded statement — at the scene or after the accident — to anyone other than law enforcement.  Only an attorney will look out for your rights and interests.

Don’t Sign Anything.  People representing others involved in the accident may ask you to sign waivers.  Do not do it!   Even if they offer money.   Don’t sign anything.   Only an attorney will protect your interests.

Don’t Miss Appointments.  Don’t miss any doctor or treatment appointments.   Missing appointments delays your recovery and may weaken your claim.

Don’t Attempt to Negotiate.   Auto accidents involving injuries can be complex.   Insurance companies rely on professional adjusters to negotiate.    In order to deal with these professionals, you need a highly-trained, skilled attorney to protect your rights and negotiate on your behalf.   We are knowledgeable and experience in pursuing compensation for victims of auto accidents.  We know your rights and the applicable laws.  We are your advocates.  We are experts at negotiating with powerful insurance companies.    Experience counts.

Print this auto accident checklist and keep it in the glove box of your car.  You’ll thank me if you’re in an auto accident.
